Comment Period Now Open to Reschedule Cannabis from Schedule I to Schedule III
Due to a recent proposal by the Drug Enforcement Administration, Health and Human Services, and Food and Drug Administration to reschedule cannabis from Schedule I to Schedule III, the federal government is now accepting public comments that will be considered as the process progresses. The public comment period ends on July 22, 2024. When recommending or determining that a drug should be controlled (and if so, under which schedule), the Secretary and the Attorney General must consider eight factors that include: 1. The drug’s actual or relative potential for abuse; 2. Scientific evidence of its pharmacological effect, if known; 3. The state of current scientific knowledge regarding the drug or other substance; 4. Its history and current pattern of abuse; 5. The scope, duration, and significance of abuse; 6. What, if any, risk there is to the public health; 7. Its psychic or physiological dependence liability; and 8. Whether the substance is an immediate precursor of a substance already controlled.
